Service · Trade promotions & competitions

Launch the promo.
Not a compliance problem.

Australian trade promotion terms and conditions for giveaways, prize draws, instant wins and skill-judged competitions — plus a claims check on the advertising that carries them.

  • Games of chance & skill
  • Permit-ready drafting
  • All states & territories

Compliance

First question: chance or skill?

Terms have to hold up when someone disputes the winner. The mechanic decides the rules, and most disputes trace back to that call — or to an entry period with no timezone, a loosely described prize, no right to disqualify or redraw.

Game of chance

Random draws & instant wins

Winners are picked at random, so the promotion is a trade promotion lottery inside state and territory gaming regulation.

  • Draw date, time and place matter
  • Permit or notification may apply by prize pool
  • Redraw rules prescribed in some jurisdictions

Game of skill

Judged competitions

Winners are chosen on merit against stated criteria — generally outside gaming regulation, provided the judging is genuine.

  • Criteria must be real, stated and applied
  • A random tie-break can pull chance back in
  • Content licences and consents become central
  • Permits & notifications — per jurisdiction, lodged where required
  • Australian Consumer Law — prize claims, “free” and consumer guarantees
  • Platform rules — Meta, Instagram, TikTok, LinkedIn, YouTube
  • Privacy — collection notices, consent, entrant data
  • Category overlays — alcohol, food, health, financial, children
  • Agency & partners — who carries the risk

Rules change, and what applies depends on your mechanic, prize pool, channels and category. We confirm the current position for your campaign rather than relying on last year’s template.

Before you brief us

Three questions we always get.

Do we need a permit to run our competition?

It depends on the mechanic, where entrants come from and the size of the prize pool. Requirements differ by state and territory and have changed in recent years, so we check the current position and prepare anything that needs lodging.

Can we reuse the terms from our last promotion?

Sometimes — if the mechanic, prizes, channels and jurisdictions are genuinely the same. Problems appear when a draw becomes a judged competition, a prize pool crosses a threshold, or a retail partner joins. That’s what the mechanic review in the promo pack is for.

How fast can you turn terms around?

A straightforward promo pack is usually drafted within a few business days of a complete brief, and we agree the turnaround with the fee before starting. Tell us your launch date and we’ll be honest about whether it’s achievable.
